Studio Terms of Use
The studio and the "studioreif" project are designed to enable young people aged 12 to 26 with a connection to Wiesbaden to express themselves creatively using photos, audio and video - for example, by creating new broadcast and media formats, by placing their own topics in their self-designed products and acquiring knowledge and skills, in short, by becoming media-competent and thus contributing well to social discourse. No prior knowledge is required from the groups or individuals using the studio.

§ 1 General authorized users of the studio
- The term studio refers to all rooms available for this purpose, including the technology, props and furniture available there.
- Use of the studio is reserved for teenagers and young adults aged 12 - 26 with a connection to Wiesbaden (e.g. place of residence, attending school/university). This is primarily an educational offer that 12-26 year olds use in their free time.
- Use of the Studio is free of charge if users agree to their media products being published in full or in excerpts via the channels of the Media Center and the sponsors of the Studio project and its partners (see information above). In general, the use of the Studio may not serve commercial purposes. The monetization of published works, e.g. through automatically displayed advertising on popular video platforms, is permitted as long as it is not the main source of financial income for users. In case of doubt, the management of the media center will decide and may request proof of other sources of income from the users.
- The rights of the collecting societies, in particular GEMA, must be observed and, if necessary, obtained and compensated. Otherwise, the provisions of the Copyright Act and the German Civil Code (BGB) apply.
- In principle, laws and third-party rights may not be violated.
- Use of the studio is reserved for individuals and groups of up to eight people (with the exception of workshops). If the studio is used by a group, one person is responsible for compliance with the terms of use. This person is also liable in the event of late fees.
- In the event of loss or damage, the studio user is liable for all damages causally related to the use of the studio, up to the amount of the replacement or restoration price.
- Use of the studio is only possible during studio opening hours. Other times of use must be agreed with the management. The use of the studio requires careful handling of the available equipment and the premises. Users are responsible for setting up and dismantling the equipment and furniture. The original condition of the premises must be restored after each project.
- Associations and companies that carry out educational media projects with authorized users can enter into a cooperation with Medienzentrum Wiesbaden e.V. and use the studio as well. A cooperation agreement will be concluded for this purpose.
§ 2 Prerequisite for the first use of the studio
- Before using the studio for the first time, a signed declaration of consent must be submitted by each active user or their legal guardian. This regulates the processing and storage of personal data, the granting of the media center's rights of use and publication of the resulting productions, the consent to making-of recordings by the media center/its partners and ensures that the information on data protection and compliance with legal regulations has been taken note of.
§ 3 Special terms of use
- Mobile use of the studio equipment is only possible for users who are competent in handling the equipment to be borrowed. Before use, an identity card must be presented to the studio staff. Mobile equipment may only be used during studio opening hours. Borrowed equipment may only be operated by competent persons. Equipment may only be loaned to individual persons who are personally liable for the items borrowed. Some equipment may only be loaned to persons over the age of 18. Further details are regulated by the management of Medienzentrum Wiesbaden e.V.
- A written contract must be concluded for each loan. By borrowing equipment, the user accepts the terms and conditions of use and rental. The borrower confirms with their signature that they have accepted the media and equipment in perfect working order. The person should verify this when handing over the media at the media center or instruct the person collecting the media to do so on their behalf.
- The written return date is binding. Non-compliance will result in late fees.
- The equipment may not be misused.
- Failure to comply will result in exclusion from further rentals.
- As the value of some equipment amounts to four to five-figure sums (in euros), it is advisable to take out private liability insurance or professional liability insurance if this cover is not provided by the employer.
- A late fee will be charged for equipment returned late or incomplete. This amounts to 15 euros per day of delay or part thereof. The return date stated on the rental certificate is decisive. For incompletely returned equipment, e.g. missing cables or accessories, either the replacement value of the missing parts will be charged (but at least 5 euros per missing part) or the above-mentioned late fee will be charged for the later return of the parts.
§ 4 Provision of the project files
- The users of the studio, as well as the extended possibilities (e.g. editing rooms, mobile devices), agree that the Medienzentrum Wiesbaden e.V. may use the productions created in the studio or with the studio technology in whole or in part for public relations purposes. Users undertake to provide copies of the files created and the final version of the project to Medienzentrum Wiesbaden e.V.. In addition, users agree to the storage of the project data by Medienzentrum Wiesbaden e.V..
- The users themselves are responsible for backing up the project data.
§ 5 Entry into force
These terms of use enter into force on 18.04.2023.
