Entitlement to benefits under the Asylum Seekers' Benefits Act (AsylbLG) depends on a person's status under immigration law. The benefits include material security for refugees in the form of cash and non-cash benefits. People whose stay in the country can be considered secure and who already have a residence title (e.g. a residence permit) will in most cases be able to apply for benefits in accordance with Social Code II (citizen's allowance, basic security for jobseekers, "Hartz IV") or Social Code XII (social assistance).
The Asylum Seekers' Benefits Act (AsylbLG) regulates the material support of asylum seekers and people who are already obliged to leave the country. The benefits are based on the different statuses. They are provided in cash and in kind and reach a maximum of the level of social assistance according to SGB XII.
According to the statutory regulations, the necessary requirements for food, accommodation, heating, clothing, health and personal care and household consumer goods can be provided as benefits in kind or in cash. In addition, benefits for illness, pregnancy and childbirth and participation (BUT), i.e. lump sums for school supplies, school trips, tutoring, are also granted.
