Right of first refusal

In accordance with Sections 24 et seq. of the German Building Code (BauGB) and Section 23 (6) of the Hessian Water Act (HWG), the state capital of Wiesbaden has a statutory right of first refusal when purchasing land.

Once a property purchase contract has been concluded, the contents of the contract must be notified to the State Capital of Wiesbaden without delay. As a rule, this notification is made by the notary's office recording the contract, provided it has been authorized to do so by the contracting parties.

If there is no statutory pre-emptive right or if an existing one is not exercised, the City of Wiesbaden will issue a negative certificate (waiver of pre-emptive right) for submission to the land registry, which is subject to a fee.

The signed and sealed negative certificate will then be sent to you by post.
