Recognize paternity

Recognition of paternity enables the father to be entered on the child's birth certificate in the case of unmarried parents. The declaration of acknowledgment of paternity can be made at any registry office and youth welfare office in Germany, as well as with notaries. The mother's consent is required for recognition. The acknowledgement of paternity and the mother's declaration of consent are notarized in public form. Recognition of paternity of a child is only effective if paternity of another man does not already exist. If a child is born during divorce proceedings, we will be happy to advise you on a "qualified acknowledgement of paternity".

If the mother and/or father of the child are minors, the legal representatives must give their consent.

Recognition creates a family relationship between father and child with consequences under maintenance and inheritance law. The legal representation and surname of the child remain unaffected. If, in addition to acknowledging paternity, joint custody is also desired, it is advisable to make an appointment with the youth welfare office (or notary).

Acknowledgment of paternity is permissible before the birth, but only becomes effective with the birth of the child.

Important: Please remember to make your appointment for the acknowledgment of paternity (and declaration of custody, if applicable) as early as possible before the birth of the child.

The paternity acknowledgement service is also offered at the local administrative offices.
