Basic income support in old age and in the event of reduced earning capacity (SGB XII)
People who have reached the statutory age limit for a standard old-age pension or who are permanently fully disabled at the age of 18 can receive basic security benefits in accordance with Chapter 4 of the Social Code Part XII (SGB XII) if their existing income and assets are not sufficient to secure their livelihood from their own resources.
The granting of benefits is dependent on an application and is generally granted for 12 months. An application for further approval must be submitted for an extension.
The entitlement is subject to the principle of subordination, i.e. if there is an entitlement to benefits from third parties, this must be realized in advance. This is not expected in the case of maintenance claims if the debtor has an annual income of less than 100,000 euros.
Assistance is available in the form of cash and non-cash benefits as well as personal advice.
