Since October 14, 2025, the following applies: All projects that only involve the demolition or removal of a building or structure are exempt from planning permission in accordance with Section 63a of the Hessian Building Code (HBO), but must be notified if necessary (building classes 4 and 5).
Exception
: If a new building is to be constructed at the same time and a permit is required for the new construction project, the demolition will automatically be reviewed as part of the building permit process.
Note
: If the demolition is subject to notification, work may not begin until the one-month period has expired.
The new regulation applies only to the building permit requirement. Other permits required under public law—for example, regarding the protection of historical monuments, nature, or species—remain in effect.
Please note
: Many buildings in Wiesbaden are protected as historical monuments (individual cultural monuments, ensembles, and protected surroundings). Please check with the local historic preservation authority to determine whether your project (demolition) requires a permit under historic preservation law.
