As a neighbor of a facility—which may be a business or simply a piece of property—you must tolerate emissions to a certain extent if you are not affected by them, or only insignificantly so.
The extent of the impact you must tolerate generally depends on whether or not there is significant nuisance, harmful environmental effects, or other hazards (e.g., factory noise in the vicinity of industrial sites or pollutant emissions from industrial facilities).
An insignificant impact exists if the official emission limits set by the TA-Lärm (Technical Instructions on Noise) or the TA-Luft (Technical Instructions on Air Quality) are not exceeded and the facilities comply with the emission limits established to prevent harmful environmental impacts. In this context, higher requirements are imposed on facilities requiring a permit than on those that do not require a permit.
