Arbitration offices

Under the Hessian Arbitration Office Act, the arbitration offices conduct conciliation proceedings in civil disputes. They also serve as the competent conciliation body in criminal matters. The arbitrators, who perform the duties of the arbitration office on a voluntary basis, are elected by the city council. They require confirmation by the presiding judge of the local court, who also exercises direct supervisory authority over them.

The specific duties of the arbitration offices:

  • In civil disputes, conciliation proceedings generally concern property claims, claims arising from neighbor law, and disputes regarding violations of personal honor.
    Under the Hessian Law on the Regulation of Extrajudicial Dispute Resolution, arbitration offices are also recognized conciliation bodies for conducting mandatory conciliation proceedings. This applies primarily to so-called neighbor disputes and claims for defamation, provided the offense was not committed in the press or on the radio. In these cases, a conciliation procedure (e.g., before an arbitration office or another recognized conciliation body) must first be conducted before the courts can be invoked. However, the disputing parties must reside in Hesse or have a registered office or branch there.

  • In criminal matters, the arbitration office only acts in certain offenses. These include trespassing, insult, violation of the privacy of correspondence, assault, threats, and property damage. In other criminal matters, the arbitrator has no jurisdiction. A private prosecution for the aforementioned offenses may only be brought if the conciliation proceedings before the arbitration office have been unsuccessful.


The arbitration office in whose district the opposing party resides or has its registered office has jurisdiction.

Exception: In disputes regarding the rental or lease of premises, the arbitration office in whose district the premises are located has jurisdiction. In disputes regarding ownership or rights in rem to a piece of real property, the arbitration office in whose district the property is located has jurisdiction.
