Arbitration offices

The arbitration offices conduct conciliation proceedings in civil disputes in accordance with the Hessian Arbitration Office Act. They are also the competent conciliation body in criminal matters. The arbitrators, who perform their duties on a voluntary basis, are elected by the city council. They must be confirmed by the board of the local court, which also exercises direct supervisory authority over them.

The specific tasks of the arbitration offices are as follows:

  • In civil disputes, the arbitration procedure generally takes place in relation to property claims, claims arising from neighbor law, and disputes concerning violations of personal honor.
    According to the Hessian law governing out-of-court dispute resolution, the arbitration offices are also recognized conciliation bodies for the implementation of the mandatory arbitration procedure. This applies in particular to so-called neighbor disputes and claims for defamation, unless the offense was committed in the press or on the radio. In these cases, a conciliation procedure (e.g., before an arbitration office or another recognized conciliation body) must first be carried out before the courts can be called upon. However, the disputing parties must reside in Hesse or have a registered office or branch there. The arbitration office in whose district
    the opposing party resides is responsible, or in the case of rental and lease disputes over premises, the arbitration office in whose district the premises are located.

  • In criminal matters, the arbitration board only takes action in certain offenses. These are trespassing, insult, violation of the secrecy of correspondence, bodily harm, threats, and damage to property. The arbitrator is not responsible for other criminal matters. A private lawsuit for the aforementioned offenses can only be filed if the arbitration proceedings before the arbitration board have been unsuccessful.
